Terms of Service

1. What Ondra Does

Ondra helps travel advisors, boutique hotels, and cruise lines turn their photo libraries into marketing content. You upload photos; Ondra tags them by ship, port, and sailing date and generates social posts, landing pages, and email content from them. You're responsible for the accuracy of any information you enter and for reviewing generated content before you publish it. Ondra is a tool, not an editor.

2. Accounts

You need an account to use Ondra. You're responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old and able to form a binding contract to create an account. One account is provisioned per agency (“tenant”); team members you invite are subject to these Terms as well.

3. Plans, Trials, and Billing

Ondra offers Basic and Pro self-serve plans billed monthly through Stripe, and a custom Enterprise plan arranged directly with our team. New subscriptions include a 14-day free trial. We collect a valid payment method when you start your trial, and your card will be charged automatically when the trial ends unless you cancel first.

Subscriptions renew automatically each billing period until canceled. You can cancel anytime from your account settings; cancellation takes effect at the end of your current billing period, and you'll keep access until then. We don't provide refunds for partial billing periods except where required by law.

If a payment fails, we'll try again and may restrict access to paid features until it's resolved. Accounts that remain past due beyond the grace period stated in your plan may be downgraded or suspended.

4. Your Content

You own the photos and other content you upload to Ondra (“Your Content”). By uploading it, you grant us a limited license to store, process, and display Your Content solely to provide and improve the Service, for example generating social posts or landing pages from your photos. We don't sell Your Content or use it to train models for other customers.

You're responsible for having the rights to any photo, logo, or other material you upload, including model releases and licensing where required. Don't upload content you don't have the right to use.

Ondra doesn't review or verify that you have those rights, and we're not responsible or liable for any claim, loss, or damage arising from content you upload without the necessary rights or permissions. If a third party claims that content you uploaded infringes their rights, you agree to indemnify and hold Ondra harmless from any resulting claims, damages, and reasonable legal costs.

5. Acceptable Use

You agree not to:

• Use the Service for anything unlawful, fraudulent, or misleading;
• Upload content that infringes someone else's intellectual property or privacy rights;
• Attempt to access another tenant's data or bypass account/billing restrictions;
• Reverse engineer, scrape, or resell the Service without our written permission;
• Interfere with the Service's normal operation, including through excessive automated use.

6. Third-Party Services

Ondra relies on third-party providers to operate, including Clerk for authentication, Stripe for billing, Supabase for data storage, OpenAI for content generation, Cloudinary for image processing, and Resend for email delivery. Your use of the Service is also subject to those providers' own terms where applicable. See our Privacy Policy for more on how we use these providers.

7. Intellectual Property

Ondra and its licensors own the Service itself: the software, design, branding, and generated templates, apart from Your Content. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business while your subscription is active.

8. Termination

You can stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, don't pay amounts owed, or if we discontinue the Service, with notice where practical. On termination, your right to use the Service ends, though provisions that by their nature should survive (billing, liability, disputes) will continue to apply.

9. Disclaimers & Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. We don't guarantee that AI-generated content will be error-free, accurate, or suitable for publication without your review.

To the fullest extent permitted by law, Ondra and its team won't be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in-app before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
